人社部:2017年底,實現所有在建工程項目全覆蓋發布時間:2017-07-24  來源:本站   訪問量:

近(jin)日,人(ren)社部再次發(fa)文,要(yao)求重點解決(jue)工程建設領域欠(qian)薪問題(ti)。從現在起,在工程建設領域,


全面(mian)推(tui)行勞動用工實(shi)名制(zhi)(zhi)管理(li)。2017年底前,實(shi)名制(zhi)(zhi)管理(li)覆(fu)蓋(gai)40%以上在建工程項(xiang)目;2019年底基本實(shi)現全覆(fu)蓋(gai)。


全面推行工資(zi)保證(zheng)金制(zhi)度。實行差異化(hua)繳存(cun),推行銀行保函(han)等第(di)三方擔保制(zhi)度。到2017年底,基本實現所(suo)有在建工程(cheng)項目全覆蓋(gai)。

各省、自治區、直轄市(shi)及(ji)新疆生產建(jian)設兵(bing)團人力資源(yuan)社會保障廳(局):


為進(jin)一步貫徹《國(guo)務院辦公(gong)廳關(guan)于全面治理拖欠(qian)農民工(gong)工(gong)資問(wen)題的意見》(國(guo)辦發〔2016〕1號)和國(guo)務院第163次常(chang)務會議(yi)精(jing)神(shen),確保到2020年實現基本無拖欠(qian)的工(gong)作目標,解決企(qi)業拖欠(qian)工(gong)資問(wen)題部際(ji)聯席會議(yi)辦公(gong)室制定了《治欠(qian)保支三年行動計劃(2017-2019)》,現印發給(gei)你(ni)們,請會同協(xie)調機制成(cheng)員單位認真抓好落(luo)實。

治欠保支三年行動計劃(2017-2019)


一、行動目(mu)標


以解決工(gong)(gong)程建設領域欠(qian)(qian)薪問題為重點,綜合運用法律(lv)、行政、經濟(ji)等(deng)手段,健全源頭(tou)預防、動態(tai)監(jian)管、失信(xin)懲(cheng)戒相結合的制度保障體系,用三年左右(you)時間,形成制度完備、責任落實(shi)(shi)、監(jian)管有力的治理(li)格局,實(shi)(shi)現(xian)被欠(qian)(qian)薪農民工(gong)(gong)比重逐(zhu)年下降,力爭到2020年實(shi)(shi)現(xian)農民工(gong)(gong)工(gong)(gong)資基本無拖欠(qian)(qian)。


二、行動措施


(一)全面推(tui)行(xing)勞(lao)動用(yong)工(gong)實(shi)名制管理(li)。督(du)促用(yong)人單位(wei)與招用(yong)的(de)農(nong)民(min)工(gong)依(yi)法(fa)簽訂勞(lao)動合同,建立職工(gong)名冊。在(zai)工(gong)程(cheng)建設(she)領域(yu),全面實(shi)行(xing)農(nong)民(min)工(gong)實(shi)名制管理(li)制度,建立勞(lao)動計酬手冊,健全用(yong)工(gong)和(he)工(gong)資支付記錄,明確用(yong)人單位(wei)對農(nong)民(min)工(gong)的(de)工(gong)資支付責任。2017年(nian)底前(qian),實(shi)名制管理(li)覆(fu)蓋(gai)40%以上在(zai)建工(gong)程(cheng)項目,2018年(nian)底前(qian)覆(fu)蓋(gai)率達到70%,到2019年(nian)底基本實(shi)現全覆(fu)蓋(gai)。


(二)落實按月(yue)足額(e)支付(fu)工資規(gui)定(ding)。督促(cu)工程建(jian)設領域用人單(dan)位依法(fa)支付(fu)農民工工資,實現(xian)月(yue)清月(yue)結。到2017年(nian)底,執(zhi)行按月(yue)足額(e)支付(fu)工資規(gui)定(ding)覆蓋(gai)80%以上在建(jian)工程項(xiang)目,2018年(nian)底前覆蓋(gai)率達到90%,到2019年(nian)底基本實現(xian)全覆蓋(gai)。


(三)完(wan)善工資支(zhi)付監控(kong)機制(zhi)。充分(fen)發(fa)揮勞(lao)動保障監察“網(wang)格化、網(wang)絡化”管理優勢,對轄區內用人單位(wei)工資支(zhi)付情況實行日常監管,對出現工資支(zhi)付困難的勞(lao)動密集型(xing)加工制(zhi)造、餐飲服務(wu)以及涉及化解過剩產能(neng)的企業,實行重點監控(kong),積(ji)極探索建立(li)欠(qian)(qian)薪預警系統,及時發(fa)現和處置欠(qian)(qian)薪隱患。


(四(si))落實(shi)(shi)工(gong)資(zi)(zi)保證(zheng)(zheng)(zheng)金(jin)制(zhi)度(du)(du)。在工(gong)程(cheng)建設領域(yu)全面推行(xing)(xing)工(gong)資(zi)(zi)保證(zheng)(zheng)(zheng)金(jin)制(zhi)度(du)(du),根據用(yong)人(ren)單位(wei)工(gong)資(zi)(zi)支(zhi)付(fu)情況,實(shi)(shi)行(xing)(xing)差(cha)異(yi)化繳存,推行(xing)(xing)銀行(xing)(xing)保函等第三方擔保制(zhi)度(du)(du),規范(fan)工(gong)資(zi)(zi)保證(zheng)(zheng)(zheng)金(jin)收繳、使用(yong)、退(tui)還辦法,實(shi)(shi)現(xian)及時收繳,按時退(tui)回。到(dao)2017年(nian)底,基(ji)本實(shi)(shi)現(xian)所有在建工(gong)程(cheng)項目(mu)全覆蓋,逐步將(jiang)工(gong)資(zi)(zi)保證(zheng)(zheng)(zheng)金(jin)實(shi)(shi)施范(fan)圍擴大到(dao)其(qi)他易發欠(qian)薪行(xing)(xing)業(ye)。


(五)建立農民(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)專(zhuan)用(yong)賬戶(hu)管理(li)(li)制(zhi)度。在工(gong)(gong)(gong)(gong)程建設領域(yu),實行(xing)農民(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)與(yu)其(qi)他工(gong)(gong)(gong)(gong)程款分賬管理(li)(li)制(zhi)度,施工(gong)(gong)(gong)(gong)企業應在銀行(xing)建立工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)專(zhuan)戶(hu),專(zhuan)門用(yong)于發(fa)放農民(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)。鼓(gu)勵實行(xing)分包企業委(wei)托總承(cheng)包企業直接向農民(min)工(gong)(gong)(gong)(gong)代發(fa)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)的(de)辦(ban)法。到(dao)2017年(nian)底(di)(di),農民(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)專(zhuan)用(yong)賬戶(hu)管理(li)(li)制(zhi)度覆蓋60%以(yi)上(shang)在建工(gong)(gong)(gong)(gong)程項目(mu),2018年(nian)底(di)(di)前覆蓋率達到(dao)80%,到(dao)2019年(nian)底(di)(di)基本實現(xian)全(quan)覆蓋。


(六)強化勞(lao)(lao)動(dong)保障監(jian)察(cha)執法(fa)。進一步暢通農民工(gong)(gong)欠薪(xin)舉(ju)報投(tou)訴(su)渠(qu)道(dao),健全(quan)勞(lao)(lao)動(dong)保障監(jian)察(cha)舉(ju)報投(tou)訴(su)案件(jian)省(sheng)級聯動(dong)處(chu)理機(ji)制。到2017年(nian)底,在(zai)各省(sheng)級行政(zheng)區域(yu)內基本實現“一點(dian)舉(ju)報投(tou)訴(su)、全(quan)網聯動(dong)處(chu)理”,為農民工(gong)(gong)提供(gong)便(bian)捷(jie)、高效的(de)(de)執法(fa)服務。通過加強日常巡視檢(jian)查(cha),督促用人單(dan)位嚴格落實按月支付(fu)農民工(gong)(gong)工(gong)(gong)資(zi)的(de)(de)法(fa)律(lv)規定(ding)。會同有關部(bu)門每年(nian)在(zai)元旦、春節和其(qi)他關鍵(jian)時點(dian)組織開展農民工(gong)(gong)工(gong)(gong)資(zi)支付(fu)情況專項檢(jian)查(cha),對(dui)欠薪(xin)違法(fa)行為實施集(ji)中(zhong)整治。對(dui)舉(ju)報投(tou)訴(su)和檢(jian)查(cha)中(zhong)發現的(de)(de)欠薪(xin)問題,勞(lao)(lao)動(dong)保障監(jian)察(cha)機(ji)構要在(zai)法(fa)定(ding)期限內快(kuai)辦快(kuai)結,做到欠薪(xin)案件(jian)限時清零。


(七(qi))充分發揮勞(lao)(lao)動(dong)(dong)爭(zheng)議(yi)(yi)(yi)調(diao)解(jie)仲裁作用。進一步加(jia)強基(ji)層(ceng)勞(lao)(lao)動(dong)(dong)爭(zheng)議(yi)(yi)(yi)調(diao)解(jie)工作,努力將涉及(ji)(ji)拖欠(qian)農民(min)工工資的(de)(de)勞(lao)(lao)動(dong)(dong)爭(zheng)議(yi)(yi)(yi)化(hua)解(jie)在基(ji)層(ceng)。勞(lao)(lao)動(dong)(dong)爭(zheng)議(yi)(yi)(yi)仲裁機構(gou)要繼續開辟爭(zheng)議(yi)(yi)(yi)處理(li)“綠色通道(dao)”,簡(jian)化(hua)辦(ban)案程序,改進辦(ban)案方式,對涉及(ji)(ji)拖欠(qian)農民(min)工工資的(de)(de)爭(zheng)議(yi)(yi)(yi)案件優(you)先受(shou)理(li)、優(you)先開庭(ting)、及(ji)(ji)時(shi)裁決、快速結案。


(八(ba))加大(da)對欠(qian)薪(xin)(xin)違法行為的信用懲(cheng)戒(jie)力度(du)。進(jin)一步加強與有(you)關主管(guan)部(bu)(bu)門對欠(qian)薪(xin)(xin)問題的協同監管(guan)和聯(lian)合懲(cheng)戒(jie),2017年底前,制(zhi)定(ding)嚴重欠(qian)薪(xin)(xin)聯(lian)合懲(cheng)戒(jie)部(bu)(bu)門合作備忘(wang)錄,制(zhi)定(ding)并(bing)組織實施欠(qian)薪(xin)(xin)企業“黑(hei)名單”制(zhi)度(du)。落(luo)實《重大(da)勞動保障(zhang)違法行為社會公(gong)布辦(ban)法》和《企業勞動保障(zhang)守(shou)法誠信等級評價辦(ban)法》,定(ding)期(qi)公(gong)布重大(da)欠(qian)薪(xin)(xin)違法案件。


(九(jiu))開展(zhan)治欠保(bao)支(zhi)(zhi)法(fa)律(lv)(lv)(lv)(lv)援(yuan)(yuan)助(zhu)和普法(fa)宣(xuan)傳(chuan)。暢通法(fa)律(lv)(lv)(lv)(lv)援(yuan)(yuan)助(zhu)渠道,在農(nong)(nong)(nong)民工(gong)(gong)(gong)(gong)集聚地和仲裁、監察等機構建立(li)法(fa)律(lv)(lv)(lv)(lv)援(yuan)(yuan)助(zhu)工(gong)(gong)(gong)(gong)作站點,方便農(nong)(nong)(nong)民工(gong)(gong)(gong)(gong)獲(huo)取信息、提出申請。法(fa)律(lv)(lv)(lv)(lv)援(yuan)(yuan)助(zhu)機構對(dui)農(nong)(nong)(nong)民工(gong)(gong)(gong)(gong)申請支(zhi)(zhi)付(fu)勞動報酬(chou)的(de)法(fa)律(lv)(lv)(lv)(lv)援(yuan)(yuan)助(zhu)案件(jian)不(bu)再(zai)審查經(jing)濟困難條(tiao)件(jian)。充分運用多(duo)種(zhong)宣(xuan)傳(chuan)媒介,廣泛宣(xuan)傳(chuan)國(guo)辦發〔2016〕1號文件(jian)的(de)主要內容和相關(guan)勞動保(bao)障法(fa)律(lv)(lv)(lv)(lv)法(fa)規,增強(qiang)用人單(dan)位依法(fa)用工(gong)(gong)(gong)(gong)的(de)法(fa)律(lv)(lv)(lv)(lv)意識,引導農(nong)(nong)(nong)民工(gong)(gong)(gong)(gong)理性維權。在每年(nian)治理欠薪工(gong)(gong)(gong)(gong)作關(guan)鍵時點,組織開展(zhan)保(bao)障農(nong)(nong)(nong)民工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資支(zhi)(zhi)付(fu)集中宣(xuan)傳(chuan)活動,形成(cheng)全社會(hui)關(guan)心關(guan)愛農(nong)(nong)(nong)民工(gong)(gong)(gong)(gong)的(de)社會(hui)氛圍。


(十)落(luo)實屬地(di)監(jian)管(guan)(guan)(guan)(guan)責(ze)(ze)任(ren)。按照屬地(di)管(guan)(guan)(guan)(guan)理、分級負責(ze)(ze)、誰主(zhu)管(guan)(guan)(guan)(guan)誰負責(ze)(ze)的(de)原(yuan)則(ze),落(luo)實解決欠薪問題屬地(di)政(zheng)府(fu)及(ji)其所(suo)屬部門的(de)監(jian)管(guan)(guan)(guan)(guan)責(ze)(ze)任(ren)。加強(qiang)對(dui)地(di)方政(zheng)府(fu)治欠保(bao)支(zhi)工作的(de)督查(cha)考核(he)(he),完善目標責(ze)(ze)任(ren)制(zhi)度(du),2018年(nian)底(di)前,推(tui)動各省將保(bao)障農民工工資支(zhi)付納入政(zheng)府(fu)考核(he)(he)評價指標體系。對(dui)屬地(di)監(jian)管(guan)(guan)(guan)(guan)責(ze)(ze)任(ren)不(bu)落(luo)實、組織工作不(bu)到位的(de)單位和(he)工作人員,依法(fa)依紀(ji)實施問責(ze)(ze)。


三、行動要求


(一)加強組織領導(dao)。各級(ji)人(ren)力資源社會保障(zhang)部門要高度重(zhong)視治欠保支(zhi)工(gong)作,把推進(jin)落實(shi)國辦(ban)發(fa)〔2016〕1號文件工(gong)作作為構建(jian)和(he)諧勞(lao)動關系、促進(jin)社會穩定的(de)重(zhong)大舉措,抓(zhua)緊(jin)抓(zhua)實(shi)。健全由本級(ji)政府負責人(ren)牽(qian)頭、相關職能部門參與的(de)工(gong)作協調機制,明確任務分工(gong),結合本地區(qu)實(shi)際細化(hua)年度工(gong)作任務、工(gong)作措施和(he)時間安(an)排,切實(shi)把治欠保支(zhi)三年行(xing)動計(ji)劃落到實(shi)處。


(二)加(jia)強(qiang)工(gong)(gong)作(zuo)(zuo)調(diao)度和(he)督促檢查。各省級人力(li)資源社會保(bao)障部(bu)門要進(jin)一(yi)步(bu)加(jia)強(qiang)對所(suo)轄地區治欠保(bao)支工(gong)(gong)作(zuo)(zuo)的督促檢查,健全工(gong)(gong)作(zuo)(zuo)臺賬,做(zuo)到(dao)責任到(dao)人、責任到(dao)崗(gang),抓(zhua)好督查督辦,層層傳導工(gong)(gong)作(zuo)(zuo)壓力(li),定(ding)期通(tong)報情(qing)況,形(xing)成(cheng)一(yi)級抓(zhua)一(yi)級的工(gong)(gong)作(zuo)(zuo)格局。解決企業拖欠工(gong)(gong)資問題部(bu)際聯席會議辦公室對各地治欠保(bao)支工(gong)(gong)作(zuo)(zuo)進(jin)展情(qing)況適時開(kai)展調(diao)度,對落實工(gong)(gong)作(zuo)(zuo)滯后的,將在一(yi)定(ding)范(fan)圍內予(yu)以通(tong)報。
